Video transcript:
why do I need to tell immigration when my circumstances changes the subject of today's East Central Business show with Bruce Kimball from Bruce Kimball migration services Bruce thank you very much come and speak to me thank you John it's a pleasure yeah now everybody says that I wonder if it's actually true though maybe we'll search Google later or to find out now but anyway enough of the the carry on now let's talk about the subject though why do you need to tell the migration Department when your circumstances change well I thought it was a very good question because it's asked of me quite quite often and questions around that essentially those questions I think a very important question there's no simple answer to it because I think it depends very much on the the individual person asking the question and their particular circumstance hmm so say if they move across town or something like that is that you need to notify migration if you've ever done that well yeah people do all different reasons everybody circumstances are changing all the time hmm but from a an applicant point of view someone who is applying for a visa the Department is very fussy about the information that these are applicants provide them when particularly from the point when the moment they lodge the application up until the point the visa is granted hmm so there are a couple of other sub questions beneath that one and that's essentially well what actually constitutes a change of circumstance what's important to you may not be important to the Immigration Department why do people need to inform the department and how do they go about that and what happens if they don't hmm okay right so what some circumstances you definitely want to you know get on the phone or get on beginning contact with migrate Department essentially when you've put an application into the Department of Immigration if there's any question that you've answered has become incorrect oh okay so the legislation is very clear they really the immigration that happened really want to know about answers that have become incorrect watch that application okay right so a question about your contact details where you live if you move house to change residence obviously the I believe you have a obligation to the apartment to inform them of that change of address mm-hmm I think there's a lot of other type of circumstances that change getting a new passport mmm having a new child oh okay or even having a new spouse or wife mmm they are obviously critically important and so when the person has lodged the application and they've picked a box that their marital status is single hmm that circumstance is now changed where they are now married no I would say the Immigration Department would be particularly interested in that piece of information now if it's a work-related visa that they're pursuing then obviously the the big deal is there is that what's going to happen if they get a there's obviously if they're going to change jobs and it's a job-related visa that's going to definitely be something they need to talk to them my garage habit if it's just a change in the job role or the job title well it's okay that they are all very there have quite legislated limitations you just can't easily move from one occupation or another and you're at risk of having a visa if you actually have been granted a visa you're at risk of having that these are canceled if the department becomes aware that you've changed your occupation that you've changed your employer yeah if you've lodged an application and you change the occupation that you've applied for is different from the one that you actually doing not having your visa refused yeah yeah okay and the other thing that sort of comes out of that too is like what what happens if you you know you're in a situation where you've yeah it's a regional base one you know that obviously yeah yeah and that's a thing and then obviously you move into the city or something or change locations that's gonna once again be in absolutely no-brainer you've got to disclose that thing absolutely and this is where I'm coming from that these are applicants need to understand the importance of those questions obviously they talk with their friends their relatives they get it half right half wrong hmm but I think in those instances I would only expect most visa applicants would be very aware of the occupations that are applied for mmm and the risk that they run and they certainly decide they're gonna live somewhere else okay but and then so what's incentive though and around there probably there's a fear based thing if they say oh maybe we just let this slide and you know is it fear that's that that is the thing that inspires it or maybe keep things under wraps yeah I think it's going to have a negative effect obviously then why would you disclose to the Immigration Department there's lots of reasons and there can be negative raisins and I think most times it's and I like to think it's an honest mistake and I come at it from that point of view that if there's incorrect information they need to correct the record there's a slight difference between an incorrect answer occurring as a result of becoming aware of that error mmm important to correct that error mmm as this thing from a change in your circumstance yeah fair enough okay great advice there Bruce but obviously disclosure is probably the best absolutely fundamentally that the outcome of this is disclosure is going to keep you in in a clear space it's my experience that the department would much prefer that you fess up rather than not disclose and there's a good examples where the department has exercised a bit more leniency not mine who has in fact fest up to something you know that's it's certainly part of the Australian Way almost okay Bruce Campbell how do people get in contact with you I think the best way of contacting me is do a google search as try a search for Bruce Kimble migration and you'll probably come up with my website and hopefully you can find my email address no they need to give it I know there's more let's probably there's a phone number email dress on the website I think that's probably the best way to go for them and obviously a wealth of information and that the the blogs you constantly write around the subjects and case studies and the rest then absolutely Bruce thank you very much for coming on the show stick around I'd like to talk to you some more if you don't mind thanks John okay great bruce campbell on the east central business show will speak to you next time
